Terms and Conditions

  1. Information on how to enter and prizes form part of these conditions.  By participating, entrants agree to be bound by these conditions.  Entries must comply with these conditions to be valid.
  2. Entry is open to residents of Australia. Entrants aged less than 18 years must have parental or guardian approval to enter.  Employees and their immediate families of the Promoter, its agencies and venues/outlets associated with this competition are ineligible to enter.

How to enter

  1. To enter entrants must during the Entry Period:
    • (a) Submit a recipe using bread wraps with an image.
    • (b) Take a photograph;
    • (c) Complete the competition entry form available on simsonspantry.com.au by providing all the requested information and uploading the photograph of their recipe.

Limit applies of one entry per person.  All costs associated with entering this promotion, including the cost of developing the recipe, are the sole responsibility of the entrant.  Entrants will not be reimbursed for amounts spent on their entry by the Promoter.

Entries must be received by the Promoter during the Entry Period.  Entries received after 31/05/2017 will not be accepted.

  1. By submitting an entry, entrants warrant to the Promoter that:
  • they own all of the rights to the entry and are the creator or owner of the recipe shown in the photograph submitted;
  • they will not make unauthorised use of any of the logos, branding or images;
  • they are the individual pictured in in the photograph (if relevant), or have obtained the permission from each other person that appears in their photograph and made them aware that the photogram and structure is being entered into this promotion and may be shown on the Promoter’s website;
  • persons featured in their photograph are aged 18 years and over or have parental or guardian consent to be featured; and
  • their image and recipe has not been entered into previous competitions, or won awards in the past or been published previously in any medium.

  1. Entrants confirm and promise that their entry, including their photograph and recipe, is original and does not infringe the intellectual property rights of any third party. Further, entrants agree that ownership of any intellectual property rights in their entry, including their photograph, is assigned to the Promoter without the payment of any further fee or compensation. Entrants acknowledge that the Promoter may use their entry, including their photograph, recipe, during the Promotion and afterwards, in any manner the Promoter sees fit including packaging and to encourage others to enter the competition online including via Facebook.  Entrants acknowledge that any use of their entry by the Promoter during the Entry Period does not constitute endorsement of their entry or guarantee that their entry will be shortlisted or will win a prize

  2. Entrants agree to sign any further documentation required by the Promoter to give effect to this arrangement as a precondition to being awarded their prize.  To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry, including their photograph.  Entrants warrant that they have the full authority to grant these rights.

  3. Entrants agree that they are fully responsible for the image they submit and the recipe they create. The Promoter shall not be liable in any way for such photograph or recipe, to the full extent permitted by law. The Promoter may remove any image from its websites without notice for any reason whatsoever. Without limiting any other terms and conditions contained herein, entrants agree to indemnify and hold the Promoter, its affiliates and sub-licensees, harmless from any and all claims, damages, expenses, costs (including reasonable legal fees) and liabilities (including settlements), brought or asserted by any third party against the Promoter, its affiliates or sub-licensees, due to or arising out of the image submitted or structure built by an entrant or the Promoter’s use thereof, or an entrant’s conduct in connection with this promotion.
  4. Entrants are solely responsible for their safety when constructing their recipe and should be careful to avoid activities or building ideas that may involve a risk of injury or harm to themselves or others.

Entry period and judging

  1. The competition commences at 12:00 (noon) AEST on 13/03/2017 and entries closes at 12:00 (noon) AEST on 31/05/2017 (“Entry Period”).
  2. This competition is a game of skill.  Chance plays no part in determining the winner(s).  Following the Entry Period, all of the entries will be judged individually on their merits based on creativity and originality.  The best 50, as determined by the judges, will be shortlisted as finalists in the competition with finalists notified by 12:00 (noon) AEST 07/06/2017
  3. Judging for the shortlisted finalists will take place at 11:00 am on 01/06/2017 Entries will be judged by a panel of judges from the Promoter.
  4. the criteria in paragraph 12.
  5. The shortlisted entry that has received the highest number of valid votes at 12.00 (noon) 16/07/2012, and that has not been disqualified or found to be invalid, will be the winner of the Prize.

The prize

  1. The Prize consists of 50 x $50 Coles Vouchers in the form of a Coles In Store Voucher made out to the entrant as per the details they submitted in their entry or made out as determined by the Promoter and agreed with the entrant. There is 1 Prize to be won per person (50 in total).  Total RRP value of Prize = $2,500.  All taxes (excluding GST) which may be payable as a consequence of receiving a prize are the sole responsibility of the winner.  If an entrant is aged less than 18 the prize will be awarded to their parent or guardian on their behalf.
  2. If the winner does not claim the prize within a 12 days of being notified of their win, or is disqualified from the competition, the Promoter may assign the prize to the entry judged the next best entry in the competition, or withdraw the prize unawarded.
  3. Prizes are not transferable.  The judges’ decision is final and binding - no correspondence will be entered into.  The Promoter accepts no responsibility for late or misdirected entries or other communications. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches or viruses.  If such problems arise, then the Promoter may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the promotion.
  4. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their sole discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.  It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
  5. If any prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value.

Notification of winners and verification of votes and entrants

  1. The winner will be notified by email by 12.00 (noon) AEST 07/06/2017
  2. The Promoter reserves the right to request verification of age, identity, residential address and any other information from entrants or voters relevant to entry into or participation in this promotion.  Verification is at the discretion of the Promoter, whose decision is final.  The Promoter reserves the right to disqualify any entrant or voter who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in, or benefits from in, any way in manipulating, interfering or tampering with this promotion.

General

  1. The Promoter shall not be liable for any loss, damage or injury suffered by any winner or entrant as a result of entering this competition or the winner accepting and/or using a prize, except for any loss, damage or injury which is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be excluded by law.
  2. Entrants consent to the Promoter using their name, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
  3. Entries, including the entrants’ photograph, remain the property of the Promoter.  Details from entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion.  By entering this promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant.
